a) Legal warranty for the Consumer Customer: The Consumer Customer (hereinafter, “Consumer“), as defined in Art. 3 of the Consumer Code (hereinafter, “Consumer Code“, Legislative Decree No. 206 of 6 September 2005), is entitled to benefit from the legal warranty provided by the Consumer Code itself under Articles 128 to 132. This Warranty provides, among other things, that the Consumer must, under penalty of forfeiture, report to Air Track Italia S.r.l. any lack of conformity found by the Consumer in the purchased product within 2 (due) months of discovery (Art. 132, Consumer Code).

Following such report, the Consumer shall have the right to request the repair or replacement of the Product, without prejudice to any other rights provided by law in favor of the Consumer.

By virtue of the aforementioned legal Warranty, Air Track Italia S.r.l. is liable for any lack of conformity that becomes apparent within 2 (two) years from the Delivery of the Product. Beyond this term, Air Track Italia S.r.l. shall therefore not be liable for any lack of conformity found by the Consumer.

In the event of replacement or repair of the Product, the warranty terms relating to the product provided as a replacement or resulting from the repair are the same as those of the original product. Therefore, the overall two-year duration of the legal warranty shall still run from the Delivery of the original product.
In order to benefit from the warranty, we recommend presenting the proof of purchase. In any case, reference is made to the provisions of the Consumer Code, Articles 128 et seq., for the regulation of the legal warranty.

b) Legal warranty for the Non-Consumer Customer (Professional): The Professional Customer, as defined in Art. 3 of the Consumer Code, is entitled to benefit from the legal Warranty provided for in the Civil Code. This Warranty provides, among other things, that the Non-Consumer Customer must, under penalty of forfeiture, report to Air Track Italia S.r.l. any lack of conformity found in the purchased product within 8 (eight) days of discovery.

The aforementioned legal warranty is valid for a maximum term of 12 (twelve) months from the Delivery of the Product. Beyond this term, Air Track Italia S.r.l. shall not be liable for any lack of conformity found by the Non-Consumer Customer.
In order to benefit from the warranty, we recommend presenting the proof of purchase.

c) Commercial Warranties: In addition to the legal Warranty provided for by the Consumer Code and as reported in letter a) above, Air Track Italia S.r.l. offers additional warranties on certain types of Products (hereinafter “PunteTese.com Warranties”), as indicated from time to time in relation to them, to ensure maximum peace of mind during your purchases.

PunteTese.com Warranties are valid from the date of purchase of the Product.
In order to benefit from PunteTese.com Warranties, we recommend presenting the proof of purchase.

• To benefit from warranty assistance, the Customer must keep the invoice (or DDT/delivery note) received with the goods. It is good practice for the customer to check the packaging and the product contained within upon arrival to verify that the received product is free from defects of any kind (it is recommended to sign with reserve with the courier; in this case, there are three days to inspect the product).
• This product is covered by a 24-month warranty under the RTB (return to base) formula, unless an extension is authorized in writing; its validity starts from the date printed on the sales document issued at the time of purchase.
  The 24-month warranty pursuant to Legislative Decree 24/02 applies to products presenting a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and the provisions of the attached technical documentation. In the event of a lack of conformity, Air Track Italia S.r.l. shall, at no cost to the Customer, restore the product’s conformity through repair/replacement or a price reduction, up to the termination of the contract. If the defect does not qualify as a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any inspection and restoration costs requested by Authorized Technical Support, as well as transport costs if incurred by Air Track Italia S.r.l..
• To obtain Technical Assistance service during the warranty period, the shipped material must be accompanied by a copy of the purchase invoice proving the purchase.
  Air Track Italia S.r.l. reserves the right to invoice the Customer for troubleshooting costs and any intervention costs related to products sent for repair that do not present manufacturing defects attributable to the product and its original components, but rather defects attributable to components added by the Customer, incorrect installation, tampering, or anything else that is not part of the original configuration of the purchased product.
• In the event that, for any reason, Air Track Italia S.r.l. is unable to return a warranty product (restored or replaced) to its customer, it may, at its sole discretion, proceed to refund the full amount paid or replace it with a product of equal or superior characteristics.
• No damages may be claimed from Air Track Italia S.r.l. for any delays in carrying out repairs or replacements.

The warranty terms shall be voided in the following cases:

• negligence, abuse, misuse, or incorrect and improper use and installation;
• cuts to the inflatable caused by the use of blades or other tools while unpacking;
• electrical surges and voltages not complying with the product specifications described in the manual or on the reference labels;
• incorrect or improper installations or modifications that do not comply with the specifications of Air Track Italia S.r.l.;
• use of non-original accessories and consumables;
• tampering with the product;
• any intervention performed by the Customer on products under warranty. Any such intervention must be previously and exclusively authorized in writing by Air Track Italia S.r.l.;
• the warranty does not cover minor defects that have a negligible effect on the value or functionality of the product (irregularities or imperfections).
